ARTICLE 2 – APPLICABILITY & TERMS

  1. Our general terms and conditions apply to every offer made by us as an online retailer to you as a consumer (any natural person who acquires or uses products or services offered on the market solely for non-professional purposes).
  2. To place an order, you must be at least 18 years old. If you are under 18, we ask that your order be placed by your parents or legal guardian. If we notice that an order was placed by a minor, we may refuse the order.
  3. Placing an order on the website constitutes your explicit acceptance of our general terms and conditions, which are always available on the website.
  4. If you order online, we will provide a copy of these general terms together with the order confirmation or at the latest upon delivery, in a format that you can save or print. We recommend that you always do so.
  5. If additional specific terms also apply, the above applies to those as well. If our general terms conflict with specific terms, you, as a consumer, may always invoke the most favorable text for your benefit.

 

ARTICLE 3 – OUR OFFER AND YOUR ORDER

  1. If an offer has a limited validity or is subject to certain conditions, we will explicitly state this in the offer.
  2. We always describe what we sell and how the ordering process works as fully and accurately as possible. The description is sufficient for you to make an informed judgment. If we use images, they are a true representation of the goods and/or services offered. However, mistakes may occur, and if we have clearly made an error, we are not obliged to deliver to you.
  3. Your order is complete, and the agreement between us is final once we confirm your order by email and receive approval for your payment transaction via credit or debit card from the card issuer. We accept Visa, MasterCard, Maestro, Bancontact, iDEAL, Sofort. If the card issuer refuses to approve your payment to us, we cannot be held responsible for delays or non-delivery. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
  4. To purchase a product, you add it to your shopping cart. Then you enter your contact and billing details. On the final overview page, you accept our general terms and confirm payment by pressing the order button. Once these steps are completed, your purchase is final.

 

ARTICLE 4 – RIGHT OF WITHDRAWAL

  1. If you purchase goods or services from us, you have the right to decide not to keep the goods within 14 days from delivery or conclusion of the contract. You can return your order without paying a penalty and without giving a reason (return shipping costs are your responsibility). Within 14 days after we have received your returned order or after you have indicated that you wish to withdraw from the contract, we will refund the full purchase price using the same payment method used.
  2. You are responsible for the direct costs of returning the goods.
  3. We may wait to refund until we have received the goods or until you have demonstrated that you have returned them, whichever occurs first.
  4. During the first 14 days after delivery, we expect you to handle the order and packaging carefully. To be able to return goods as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep them. Returned goods must be appropriate, not used, and, if possible, returned with the original packaging, all accessories, and in the original condition, taking into account our instructions below.
  5. You can return your package via post or courier.
  6. To exercise your right of withdrawal quickly and correctly for both goods and services, you can fill out the form below and send it to info@trappistwestmalle.be
    or to Brouwerij der Trappisten van Westmalle BV, Antwerpsesteenweg 496, 2390 Malle, Belgium. We will send you an email confirming receipt of your withdrawal. You can find a model withdrawal form under Annex I.

 

ARTICLE 5 – PRICE

  1. During the period stated in our offer, our prices do not change, except for adjustments due to changes in VAT or excise duties.
  2. Our prices include all Belgian taxes, VAT, fees, and services. You will never face unexpected costs. We may decide to charge shipping costs on top of the purchase price. In that case, we will always notify you before you finalize your purchase.

 

ARTICLE 6 – PAYMENT

  1. We can only accept payment through the payment modules on our website.
  2. To ensure secure online payment and protect your personal data, transaction details are encrypted using SSL technology. No special software is required to pay via SSL. You can recognize a secure SSL connection by the padlock icon in your browser’s status bar.

 

ARTICLE 7 – CONFORMITY AND WARRANTY

  1. We guarantee that our goods conform to your order and meet the normal expectations, taking into account the product specifications. We also guarantee that our goods comply with all applicable laws at the time of your order.
  2. For the supply of goods, we observe the statutory minimum warranty period of two years if the product is not in conformity with the order. This means that defects or malfunctions occurring within 2 years after delivery will be repaired or replaced free of charge.

    As far as reasonably possible, you have the choice between repair or replacement. Only if repair or replacement is excessive, impossible, or cannot be carried out within a reasonable period, do you have the right to demand a price reduction or contract termination.

    If the defect appears within 6 months of delivery, it is presumed to have existed before delivery, unless we can prove otherwise. After 6 months, you must prove that the defect existed at delivery.

 

ARTICLE 8 – DELIVERY AND EXECUTION

  1. All goods and services are delivered to the address you provide when ordering.
  2. We first confirm your order by email. If an item is in stock and payment is received, it will be shipped within 1 to 4 working days. If an item is out of stock, we will inform you of the expected delivery time. In Belgium, delivery usually occurs within 2 working days via our logistics partner. You will receive a track-and-trace code. For international deliveries, no fixed delivery time can be guaranteed.
  3. If we cannot deliver on time, we will notify you before the expected delivery date. If we fail to do so, you may cancel your order free of charge. In that case, we will refund you within 30 days.
  4. Shipments are always at our risk. You do not need to worry about goods lost in the mail. However, if you return goods within 14 days after purchase because you no longer want them, you are responsible for transport.
  5. If delivered goods are damaged during transport, do not match the order form, or do not correspond to what you ordered, you must report this as soon as possible and within 3 days, and return the goods within 14 calendar days of receipt using the included “return form.” For assistance, contact info@trappistwestmalle.be.

    We cannot be held responsible for any consequential damage due to late or non-delivery by the carrier. Our liability is limited to the value of the items proven not to have been received by the customer.

 

ARTICLE 9 – FORCE MAJEURE

  1. In case of force majeure, we are not obliged to fulfill our obligations. We may suspend obligations for the duration of the force majeure or terminate the contract.
  2. Force majeure includes any circumstance beyond our control that wholly or partially prevents the fulfillment of our obligations, including strikes, fire, operational failures, energy shortages, telecommunication failures, or unavailability of the website, suppliers, or other third parties involved.

 

ARTICLE 10 – INTELLECTUAL PROPERTY

  1. Our website, logos, texts, photos, names, and all communication are protected by intellectual property rights, which belong either to us, our suppliers, or other rights holders.
  2. It is prohibited to use or modify any intellectual property as described in this article. For example, you may not copy or reproduce drawings, photos, names, texts, logos, or color combinations without our prior written consent.

 

ARTICLE 11 – COMPLAINTS AND DISPUTES

  1. We always aim for 100% customer satisfaction. If you have complaints, contact us at info@trappistwestmalle.be or call +32 (0)3 312 92 22 (available Monday to Thursday 8:00–12:30 and 13:00–17:00, Friday 8:00–12:30, not available on holidays). We strive to handle complaints within 7 days.
  2. All agreements with our customers, regardless of residence, are governed exclusively by Belgian law, and disputes fall under the competent courts in Antwerp. If international law applies, the interpretation of these terms will primarily refer to Book VI of the Belgian Economic Law Code.
  3. For extrajudicial dispute resolution, the Consumer Ombudsman of the Federal Government is competent. Requests may be handled directly or referred to a qualified entity. Reach the Consumer Ombudsman here: https://consumerombudsman.be/
